pennsylvania enacts public works employment verification act 127 on january 1st, pennsylvania began requiring (via pennsylvania’s public works employment verification act) public works contractors and subcontractors to enroll and participate in the federal e-verify electronic employment eligibility verification system. the internet-based system confirms the legal works authorization status of newly hired employees by comparing information from the employee’s form i-9, employment eligibility verification, to data from u.s. department of homeland security and social security administration records.
as part of the act, contractors and subcontractors are required to submit employee verification forms to the municipality, municipal authority or other government contracting body certifying the contractor’s participation in the e-verify system as a precondition to being awarded a construction contract.
the department defines a “public work” to be construction, reconstruction, demolition, alteration and/or to repair work other than maintenance work, done under contract and paid for in whole or in part out of the funds of a public body where the estimated cost of the total project is in excess of twenty-five thousand dollars ($25,000) but shall not include work performed under a rehabilitation or manpower training program.
